1. Acceptance of these terms
By signing in to the GharSewa website (gharsewa.co.in) or the GharSewa iOS / Android applications (together, the “Platform”), you agree to these Terms of Service (“Terms”) and to our Privacy Policy. If you don't agree, please don't use the Platform.
These Terms form a binding contract under the Indian Contract Act, 1872 between you and GharSewa Technologies Private Limited(CIN: U72200DL2026PTC123456), with registered office at Dwarka, New Delhi 110075, India (“GharSewa”, “we”).
2. What GharSewa is (and isn't)
GharSewa is a marketplacethat connects customers with independent professionals (“Pros”) for home services like AC repair, cleaning, salon-at-home and similar. We are notthe service provider — the Pro who attends your booking is the service provider for that booking. We're an intermediary as defined under Section 2(w) of the Information Technology Act, 2000.
This means: we vet Pros (background check, skill assessment), set quality standards, run the booking and payment infrastructure, and back every job with a warranty — but the work itself is performed by the Pro. Disputes about service quality are resolved through GharSewa's grievance process (Section 11).
3. Eligibility
- You must be at least 18 years old.
- You must have legal capacity to enter contracts under the Indian Contract Act, 1872.
- You must provide accurate phone, name and address information.
- You may not use the Platform for any unlawful purpose or any service Indian law prohibits.
4. Bookings, pricing and payment
- Prices shown in the app are final, inclusive of GST unless explicitly marked otherwise. A small convenience fee (currently ₹49) is added at checkout.
- Payment is collected at booking time through Razorpay (UPI, debit/credit card, net banking, wallets). We do not store your payment credentials — Razorpay handles them under PCI-DSS Level 1 controls.
- Surge pricing may apply on high-demand days (festivals, weekends). The price you see at the moment of booking is the price you pay — no later top-up.
- Pros may quote additional charges only for materials clearly outside the booked scope (e.g. AC gas refill on a service that was booked for cleaning only). Any such add-on requires your explicit in-app confirmation before the Pro proceeds.
5. Cancellation, rescheduling and refunds
- Free cancellation up to 2 hours before your slot — full refund.
- Within 2 hours of your slot: a small cancellation fee (currently 20% of the booking value) is retained to compensate the assigned Pro for blocked time. The rest is refunded.
- No-show / Pro can't reach you: if the Pro arrives and you're not reachable for 15 minutes, the booking is treated as a no-show and the full amount is forfeited. We always send a 30-minute and a 10-minute heads-up SMS so this almost never happens.
- Refund timelines: UPI within 24 hours; card refunds 3–5 business days; wallets within 48 hours. Initiated automatically — no need to ask.
6. 30-day service warranty
If you're not satisfied with a service within 30 daysof completion, we'll send a Pro back to fix it free of charge. Open the completed booking → “Raise a concern” → describe the issue. Warranty doesn't cover:
- Damage caused by ordinary wear and tear after the service.
- Damage caused by you or a third party after the service.
- Issues unrelated to the scope of the original booking.
7. Your responsibilities
- Provide a safe working environment for the Pro (well-lit area, clear access, no dangerous animals).
- Be present, or have an adult representative present, while the service is performed.
- Do not engage Pros for any service outside the booking, or attempt to hire them outside the Platform within 12 months (we use this to keep prices fair for everyone).
- Don't harass, threaten or discriminate against Pros. We will permanently block accounts that do.
- Don't spam, scrape, reverse-engineer or attempt to disrupt the Platform.
8. Pro responsibilities
Pros agree to a separate Partner Agreement covering background verification, service standards, dress code, tooling and conduct. In short, every Pro you book has:
- Cleared a 4-step verification (government ID, address proof, police clearance, skill test).
- Agreed to GharSewa's pricing — they will not ask for tips up-front (post-service tipping is opt-in from the rating screen).
- Carried tools and standard consumables for the booked service.
9. Limitation of liability
To the maximum extent permitted by law:
- Our total liability to you for any single booking is capped at the higher of ₹10,000 or 3× the booking amount.
- We're not liable for consequential, indirect or punitive damages (loss of business, loss of opportunity etc).
- We carry general-liability insurance for material damage caused by Pros during a booking, up to ₹50,000 per incident — claim through the in-app support flow within 7 days of the booking.
These limits do not apply to gross negligence or wilful misconduct on our part, or to anything Indian consumer-protection law specifically prohibits limiting.
10. Intellectual property
The GharSewa name, logo, UI design, source code, marketing copy and illustrations are owned by us and protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You get a non-exclusive, non-transferable licence to use the Platform for your personal, non-commercial bookings. Everything else is reserved.
Content you upload (avatar, address labels, ratings) remains yours, but you grant us a worldwide, royalty-free licence to use it for the purpose of running the Platform (e.g. showing your address to a Pro to dispatch the booking).
11. Grievance redressal & disputes
We aim to resolve every concern through the in-app “Raise a concern” flow within 48 hours. If you're not satisfied, escalate to our Grievance Officer (contact details in the Privacy Policy) — response within 24 hours, resolution within 15 days, in line with Rule 5(9) of the IT Rules 2011 and the Consumer Protection Act, 2019.
Governing law: these Terms are governed by the laws of India. Jurisdiction: courts at New Delhi have exclusive jurisdiction over any dispute arising from these Terms or your use of the Platform.
Arbitration:any dispute that cannot be resolved through the grievance process within 30 days will be referred to a sole arbitrator under the Arbitration and Conciliation Act, 1996. Seat & venue: New Delhi; language: English.
12. Termination
You may delete your account at any time from Profile → Preferences. We may suspend or terminate your account if you breach these Terms, attempt fraud, harass Pros, or use the Platform for an unlawful purpose. Termination doesn't affect outstanding payment obligations or rights that survive by their nature (e.g. liability limits, IP ownership).
13. Changes to these terms
We may update these Terms as the Platform evolves. Material changes will be announced in-app and via a notice on this page; the “Last updated” date at the top will reflect any change. Continued use after a change constitutes acceptance.
